En el presente trabajo se examina la relación del concepto legal de riesgo en la alimentación desde una óptica teórica incluyendo la postura del derecho norteamericano y de la Comisión Europea, así como los aspectos prácticos que se derivan de los pronunciamientos judiciales del Tribunal de Justicia de la Comunidad Europea en materia de riesgos alimentarios y aplicación de principio de precaución en el ámbito del derecho alimentario.
